This FAQ explains why having AgriProve act as the proponent of carbon projects reduces the risk and administrative burden for landholders.

What does it mean for AgriProve to act as the proponent?
When AgriProve acts as the proponent, we assume responsibility for all regulatory compliance, including any legal (civil and criminal) penalties for non-compliance. This shifts the compliance risk away from the landholder, allowing them to focus on farm management without worrying about legal responsibilities tied to the carbon project.

Why is it beneficial for AgriProve to be the proponent rather than the landholder?
Having AgriProve as the proponent reduces the landholder’s risk and administrative burden. We handle all communication with the Clean Energy Regulator (CER) and manage the compliance process with our experienced team. By taking on these responsibilities, AgriProve allows landholders to avoid navigating the complex legal and regulatory landscape themselves.

Does AgriProve being the proponent offer flexibility to the landholder?
Yes, it offers significant flexibility. Landholders have the option to cease active project implementation at any time while AgriProve continues to manage the project administratively, ensuring compliance is maintained and ACCU relinquishment is avoided. If the landholder were the proponent, they would have to take on these administrative responsibilities for a non-active project.

Who is responsible for ACCU relinquishment if the project ends prematurely?
AgriProve takes on the risk of ACCU relinquishment unless the project is terminated by the landholder in breach of our Master Terms and Conditions, such as within the 25-year permanence period. This provides additional protection for the landholder.

What happens if the farm is sold?
With AgriProve as the proponent, the project does not need to be terminated when a farm is sold, preventing the need to relinquish ACCUs. AgriProve will work to ensure the project is novated to the new owner, allowing it to continue seamlessly.

How does AgriProve’s role as proponent improve the project start-up process?
AgriProve can register projects with the CER immediately, allowing for a faster start. If the landholder were the proponent, they would first need to be established with the CER, which could delay the project by an additional three months.
